Welcome to Kenyan Drivers Association ("we," "our," or "us"). By accessing or using our website, mobile application, and services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our Platform.

These Terms apply to all users of the Platform, including drivers, employers, and visitors. If you do not agree to these Terms, please do not use our Platform.

2. Definitions

"Driver" means an individual who registers on the Platform to offer driving services.

"Employer" means an individual or entity seeking to hire drivers through the Platform.

"User" means any person who accesses or uses the Platform.

"Content" means all information, text, images, photos, and materials posted on the Platform.

"Premium" refers to paid membership offering additional features and benefits.

3. Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and accept all risks of unauthorized access
Notify us immediately of any unauthorized use of your account
Be at least 18 years old to register as a driver

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Driver Registration Requirements

To register as a driver on our Platform, you must:

Hold a valid Kenyan driver's license
Possess a valid Kenyan National ID
Be at least 18 years of age
Provide accurate and verifiable personal information
Agree to background checks and verification processes
Comply with all applicable Kenyan traffic laws and regulations

We reserve the right to verify any information provided and may reject applications that do not meet our standards.

5. Verification and Documents

To maintain the integrity of our Platform:

Drivers must submit valid identification and license documents
All submitted documents are subject to verification
We reserve the right to reject fraudulent or unclear documents
Verified drivers receive a verification badge on their profile
Documents may be shared with employers upon driver consent

We take document security seriously and implement measures to protect your personal information.

6. Premium Membership

Premium membership offers additional benefits including:

Featured placement in search results
Contact information visibility to employers
Premium badge on profile
Priority customer support
Profile analytics and insights

Pricing: Premium membership is a one-time payment of KES 500 (Kenya Shillings Five Hundred). This is a lifetime membership with no recurring fees.

Payments: All payments are processed through M-Pesa Pay Bill (Till Number: 4206034). Premium status is activated after payment verification (typically 24-48 hours).

Refunds: Premium membership fees are non-refundable once activated. If your payment cannot be verified, we will work with you to resolve the issue.

7. User Content

By posting content on our Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content. You represent that:

You own or have the necessary rights to your content
Your content does not violate any third-party rights
Your content is accurate and not misleading
Your content complies with all applicable laws

We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

8. Prohibited Conduct

You agree not to:

Post false, inaccurate, or misleading information
Impersonate any person or entity
Use the Platform for any illegal purpose
Harass, abuse, or harm another person
Collect user information without consent
Interfere with the operation of the Platform
Attempt to gain unauthorized access to any part of the Platform
Use automated systems to access the Platform

9. Privacy and Data Protection

We are committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and share your personal information. By using our Platform, you consent to our data practices as described in the Privacy Policy.

We only collect information necessary for Platform functionality
We do not sell your personal information to third parties
You can control what information is visible on your profile
Premium members have enhanced visibility options

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We make no representations about the accuracy, reliability, completeness, or timeliness of any content on the Platform.

We are not responsible for the conduct of any user, including drivers and employers. We do not endorse any driver or employer and are not liable for any disputes or issues arising between users.

11. Limitation of Liability

To the maximum extent permitted by law, Kenyan Drivers Association and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your use or inability to use the Platform
Any conduct or content of any third party on the Platform
Unauthorized access to or alteration of your transmissions or data
Statements or conduct of any third party on the Platform

Our total liability to you shall not exceed the amount you paid to us, if any, for using the Platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kenyan Drivers Association and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to the Platform
Your violation of any term of these Terms
Your violation of any third-party right, including without limitation any copyright, property, or privacy right
Any claim that your content caused damage to a third party

13. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of the Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you through the Platform or via email. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
